Terms of Service

These terms are between you and NEXGEN ESTATE PLANNING SOLUTIONS PRIVATE LIMITED, which operates Saral Will. By creating an account or paying for a plan, you accept them.

Please read the sections on what the service is not and our liability carefully.

We provide a technology-enabled Will drafting service. Specifically, we:

• ask you structured questions about your family, assets and wishes;
• generate a Will document from your answers, structured under the succession law that applies to you;
• make the completed Will available to you as a PDF to print and sign; and
• provide guidance on the signing and witnessing process.

The website, questionnaire, drafted document and general information we publish are not individual legal advice. Using Saral Will does not, by itself, create a lawyer-client relationship between you and NEXGEN ESTATE PLANNING SOLUTIONS PRIVATE LIMITED or any individual legal professional.

For complex estates, assets in more than one country, business succession, contested family circumstances, or where you expect your Will to be challenged, we recommend obtaining personalised legal advice.

You may use Saral Will only if you:

• are at least 18 years old;
• are of sound mind and are making your Will freely, without coercion; and
• are making a Will governed by Indian succession law.

Keep your password confidential and do not let anyone else use your account. Tell us promptly at info@saralwill.com if you think someone else has accessed it.

Your Will is only as good as the information you give us. You are responsible for making sure that:

• names, relationships and asset details are accurate and spelled correctly;
• you actually own what you are giving away, and are free to give it away;
• you tell us about anything unusual, including jointly held property, nominations, an existing Will, assets outside India, or a family arrangement; and
• you review the draft before downloading or signing it.

A Will is not effective until it is signed on paper. Indian law does not recognise an electronically signed Will. You must print your Will, sign it, and have two witnesses attest it.

Saral Will provides guidance for this process, but the signing happens away from us and we do not supervise execution.

Prices are shown on the site and are exclusive of GST, which is added at 18%. The all-inclusive figure is displayed before you pay.

Cancellation and refunds are covered by our Refund & Cancellation Policy.

Once you start creating your Will, you have 30 days from the date of payment to complete your Will and provide the required information through Saral Will.

After the 30-day period, your entered information may continue to be visible in your account for reference; however, the Will will no longer be available for download through the platform.

We are responsible for doing our work with reasonable care and skill. We are not responsible for:

• a Will that is invalid because it was not signed or witnessed correctly;
• consequences of information you gave us that was wrong or incomplete;
• how a court later interprets your Will, or the outcome of any challenge to it;
• assets outside India, or the effect of foreign law; or
• tax consequences of your dispositions.
